An objective is clearly put forward "to administer the country according to law and to construct the country which is ruled by law" in the Fifteenth National Congress of the Party Committee of P. R. China. It is the basic method and strategy for the Party to administer the country in line with the law. To carry out the requirements of managing the country by law, all of governmental departments and agencies must make an administration in accordance with the law. However, the department of personnel, as one of important functional departments of government, is held greatly responsible in the process of administering the country through the law, because its personnel affairs are involved broadly and directly concerned with the immediate interests of cadres and staff with strict policies.Currently, the construction of personnel legal system is quite weak in our country. It is mainly manifested that the level of personnel legislation is lower, the system of laws and regulations for personnel talents needs to be improved and perfected, and there exists the phenomena of not using the present law, not strictly executing the law and weakly correcting the faults in the process of implementing the law. These issues are not accustomed to the responsibilities and tasks taken by the personnel department. Therefore, It makes a realistic significance to fasten the construction of personnel legal system. It is an important support to carry out the personnel strategy, an inevitable request to deepen the reform of personnel system, a major symbol to make the personnel administration scientific, a main content to transform the functions and working styles of personnel department, and also a necessary countermeasure to confront the challenge of entering WTO.With such cognition mentioned above and based on analyzing the current situation of personnel legal system extension, the writer works out several tentative ideas about strengthening the construction of personnel acts in our country. The whole dissertation consists of three chapters as follows:Chapter One, it focuses on expounding the relations between constructing thepersonnel legal system and administering the country according to law. Meanwhile, it stresses on interpreting the important role of carrying out the administration by law through personnel departments in the process of implementing the strategy of administering the country according to law. It will support and guarantee the execution of our national talent strategy.Chapter Two, it is to mainly analyzing the current situation and the existing problems of our national personnel legal system in detail, and deeply exploiting the profound reasons of the problems. Then a prospect is made for the tendency of our national personnel legislation construction through drawing on the foreign countries' experiences in the field of legal system construction.Chapter Three, it is to submit a train of thought and a conception of enforcing the construction of our national personnel acts. The main breakthrough point is to quickly put National Public Servant Act into effect on the respect of personnel legislation, to formulate the public servant system and establish a complete system of laws and regulations as well as putting forward the construction of law and regulation system on the development of talent resources and, setting up and improving six big systems of laws and regulations, i.e. Policies, Laws and Regulations for Talents' training, Talents' Introduction, Talents' Employment, Talents' Encouragement, Talents' Guarantee System and Talents' Supervision; and to probe and consummate the management system of enterprises' operation managers. It is to form three big mechanisms for the enforcement of personnel laws and regulations, i.e. to establish new mechanisms for the effective enforcement of laws and regulations, the supervision and the inspection of enforcing the laws and regulations.
