Organization for Economic Cooperation and Development (OECD) pointed out in the report of 1995,the human capital investment carried on by the enterprise has already become one of the important factors which have driven economic development. As to enterprise, this investment will not only raise the stock of human capital, but also contribute to guaranteeing its competition advantage. Like investment of material capital, the human capital investment of the enterprise is unavoidable to face certain risk. But the difference is that the risk of human capital investment comes from the uncertainty of the people's subjective behavior while the risk of material capital investment derives from the uncertainty of the objective environment. An important form of this kind of investment risk is the loss of the staff who has accepted the human capital investment from the enterprise. With the constant promotion of the market-oriented reform of our country, the brain drain has already become a question that more and more enterprises must face. But to this phenomenon, the relevant theory is analyzed actually rarely. Just under such theory and practice backgrounds, this paper confirms the final topic as "the insurance of the human capital investment of enterprise while staff flowing". The whole paper divides into four parts altogether:The first part proceeding with the unique characteristic of the property rights of human capital, has analyzed the difference between the human capital investment risk and the material capital investment risk.The second part focuses on how to reduce the risk of the human capital investment through decreasing the mobility of staff by studying two forms of contract.The third part discusses the possibility that the enterprise shift the cost of human capital investment to staff in order to reduce the risk of investment.The fourth part points out several aspects which are closely related to this paper theme, but have not been probed deeply in the article.
