Review Of The Summary Of China's Civil And Small Claims System

This thesis first analyses the shortcoming of The Civil Procedure Law of thePeople's Republic of China on the civil summary procedure. From the situation ofpeople's court applying the summary procedure, we can find that the ideal of thesummary procedure is not clear in our civil procedure laws. Especially, becausesummary procedure is not systematized, it is chaotic in the application.Corresponding to the classification of civil disputes, summary procedure should beclassified. In China, the building of small-amount lawsuits is more important. Secondly, small claim is applying for reliving the right broken by small affairs.In practice, the law of small claims is not perfect in world. But all the countries aretrying to improve it. It means that those countries know the importance of smallclaims in solutions of civil disputes and they have some common idea in some scope.By analysis the value of small claims, we want to say it is also very important inChina. In the third part, in order to build the small-amount lawsuit, this thesis suggeststhat we should solve three questions firstly. And this thesis gives the idea of solution.At last, we will construct the procedures of small-amount lawsuits.
