In the 19th century, Neapolen once said that education is the most important basis in every aspect of political issues. Countries can't govern well or understand each other better except that their people are educated very well. Education is not only the preliminary terms of a country's richness and progress, but also is urgent issue of a country. Paying importance to cultural education is one of the most important contents of modern constitutional law. After the Second World War, the right of being educated had been written into many international documents and the protection for the right of being educated has developed from abroad to international field.Nowadays, the right of being educated is a subject people are concerned about both in abroad and in international areas. In international human rights area, the realization of the right of being educated has been regarded as a duty of every country. In our country, the right of being educated is a basic right of every citizen which is regulated in the constitutional law and other relatjed regulations. From the 1954 Constitutional Law to the present constitutional law ,they all regulate that citizens have the rights to be educated. Whether the right of being educated can be realized not only concerns the improvement of the nature of citizens but also concerns the improvement of the whole country and the existence and development of a country and a nation. Our country has put educational industry onto the prior developing position. With the development of educational industry and the sense of beingeducated ,the discuss of the right of being educated is becoming very heated. Due to importance of the citizen's educated right and work of my own, 1 have chosen the topics as my master's degree article. The essay is based on the educated right stipulated in the Constitution, expounding the citizen's educated right This essay includes three parts. The first part is mainly about the problems of the educated right. It first analysis the concept of the right of being educated, then talks about the different natures and types of the right of being educated.; the second part discusses the present situation> existing problems and reasons on the educated right of our citizens; the third part expounds the action realizing conditions and legal guarantee on the educated rights of our citizens. In order to realize the right of being educated for every citizen in the world especially in our country , we must do other work such as further regulate some educational regulations ,improve the educational legal sense of the whole society and strengthen the supervision of educational law.
