Legal Regulation Of The Third Sector Research

When the globalist economics develops more quickly and China joined into World Trade Organization(WTO), in order to be geared to the requirement of market economy, our officals have to transform his functions. Thus , a good deal of social organizations produce emerge and develop, in theory, they are called the Third Departments. As the parasubstance of market economy, the Third Departments' existence is globle and protracted nature, which requires Economic Law to pay close attention to them and give an response to them. Recently, the research on the Third Departments becomes wider and wider, and they have become a kind of independent subject in Economic Law. The research on the Third Department will inevitably enrich and improve the basic theory of subjects in Economic Law.Besides introduction and conclusion, the main body of this paper includes three parts as follows:Part I studies the historic and social background of the Third Department and promulgate the objectivity and inevitability of it's product and development. This paper thinks that Third Departments' emergency exceeds the traditional opinion that social structure consists of Country and Market, and makes a conclusion that the Third Departments are kind of independent power.Part II emphasizes on the analysis of the Third Department's basic attribute, such as signification ,character, quality, framework and so on, Thereby, this paper give the Third Department a clear definition.Part III, the paper, based on the analysis of the drawback of the legal system in China ,borrows the experience of legal management of more advanced countries in market economy, and puts forward three suggestions on making laws in building and kettering our law system of the Third Department, which includes the lack of the Third Department . the opposite of the Third Department and the excess of the Third Department.In the thesis, the major contribution lies in analysizing the existent conditions and legal circumstance of the Third Department and exploring a road for its reasonable development.
