Unemployment is an inevitable phenomenon under the market economy. To an individual, unemployment means losing the source of income and the right of existence is threatened; to a country, unemployment is one of the factors that cause social unrest and state instability. Unemployment has already become a severe problem of a country and a society. As an indirect tool, unemployment insurance can be applied to prevent the disastrous harm unemployment brings to individual, and can also be adopted to create new employment opportunities. Juristically speaking, the legalization of unemployment insurance system is of great importance. It is an essential means to ensure that the unemployed are protected.Unemployment insurance system is a subsystem of social insurance which is the most important component of social security. European Union is the cradle of modern social security system. With the development of capitalism, The European Union countries have constantly reformed their own unemployment insurance legal system, and have formed the systems with historical characteristics. For example, Germany formed an unemployment insurance system of Bismarck mode, Britain, Beveridgian mode, and France, integrated mode. The unemployment insurance system of European Union is a legal system based on guaranteeing the freedom of personnel, capital, service and institution establishment, and coordinates the domestic unemployment insurance system of each member country. European Union unemployment insurance legal system and the unemployment insurance legislations of its member countries integrally constitute legal norm system of unemployment insurance among European Union.This thesis attempts to find out the ideological concept behind the legislation and put in order the basic structure and content of unemployment insurance legal system through a historical retrospect of the origin and development of unemployment insurance. Through comparing the different schools of unemployment insurance system of European Union represented by Germany, Britain and France, and studying the new manner of legal adjustment to unemployment insurance system adopted by European Union, we can learn from the way they solved the problems they encountered in their development, and put forward instructional suggestions on the new social problems our unemployment insurance legal system confronts.It must be admitted that there are still some problems, which may be the inherent sources that lead to the ineffective operation of unemployment insurance system, exist in our current unemployment insurance system, as well as the inherent impetus to reform and perfect the unemployment insurance system. This thesis analyzes the status of our current unemployment insurance legislation, lists the problems exist, and puts forward some suggestions that can better the legalization of unemployment insurance. It also points out the enhancement of protection of the unemployed youth and the disadvantaged women group, discusses the unemployment insurance legislation for the floating laborers and the peasant workers. It is hoped that this thesis can generate some ideas to perfect our unemployment insurance legislation.
