Along with people's standard of living improved, people' worry about the short of food gradually changed into the scare of the safety of food. Repeatedly occurring food safety affairs make food security become an attention focus, which turns into a world issue, e.g. BSE burst out in England in 1996 and jaws-hoof epidemic disease in Europe in 2001, etc.Food security condition in China is not optimistic, e.g. SARS affair in 2003 and "Su dan hong" problem recently, which shows there are many disadvantages in the supervision of food security, and legal system level need improving to protect the healthiness of people and international competition of our agriculture and food industry.The passage is divided into six parts. In part one, the definition of food and food safety are introduced briefly. In part two, the present status of Chinese food security needs ideal legislation protection. Although Chinese government attaches importance to the food safety, there is still great gap between China's management level and the one of developed countries. One key reason is great difference of legislation level between our country and developed countries, and our food law system frame still awaits more science and rationalization.Therefore, we need to use matured food safety lawmaking from developed countries for reference. In part three, food safety lawmaking from international organization, such as CAC and WTO, is introduced simply. We must follow the criterion of CAC and SPS and TBT under WTO if we want to joint with the world.In part four, food safety law systems from America, EU, Germany, Canada, New Zealand and Australia, and Japan are presented as emphases. And their basic legislation principles, such as "from farmland to table", "precaution", "food safety obligation", "clarity", etc, are very meaningful to help our country to make food safety law perfect.In part five, the author mainly discusses the present condition of our country's food safety law and existing problems. At present, our country's food safety law have had an elementary scale, such as national food safety law, department rules, single ruleof law aimed at different food, regulations about food providing process and rules about food safeguard system, etc. But we also should see clearly that there are still many problems, such as, the law system is not perfect, hard to operate; bad systematization and harmony; effectiveness not enough; the function and the power scope in execution system are not clear; and the performance process lack standardization and continuity, etc.In the last part, some proposals are put forward to consummate our country's food safety law. We need clear up the present statutes to meet the requirement after WTO entrance; build up the fundamental frame of our country's food safety law according to international food safety codes; combine the present statutes to reform our food safety law; give execution branches more power and strengthen punishment force of the present statutes; intensify the power supervision; set up a harmony food safety administration whose function and the power scope is clear, and better a national food safety committee, etc.In a word, food safety is an important strategic problem in the whole world. It is a strategic task to have a healthy and perfect food safety system. The present condition of home and broad compels China to meet the standards of the internationals and shorten the distance between China and developed countries. We believe that China's food safety law system will be more perfect to protect people's health better, to promote international food trade and play a indispensable role in our social life.
