Disclosure Of Anti - Dumping Law Of Administrative Procedure

This paper discuss the information disclosure process anti-dumping's administrative authority discloses relevant information to interested parties and outside, pursuant to the basic principle of procedural justice, and based on WTO's transparent principle and statutes in WTO Anti-dumping Agreement, introduced the concepts of information and information communication in information science and communication science, comprehensively discussed the information disclosure system in administrative procedure of anti-dumping law. According to WTO Anti-dumping Agreement and anti-dumping practice of the members' governments, concluded what information should be disclosed to interested parties and outside by administrative authority, and which manner are suitable for such disclosure. Interested parties' participation is critical to a fair and satisfying information disclosure system, it should be included in the design of such system and in which the explicit stipulation of time limit is a necessary guarantee of such participation. Confidential information and the application of BIA or FA are the limit to disclosed information range or critical to interests of interested parties, this paper specially discussed these two important sub-systems pursuant to WTO Anti-dumping Agreement and WTO's panel and DSB's precedents. In the conclusion part, this paper reviewed the overall legal frame of China's information disclosure in anti-dumping's administrative procedure and proposed improvement to this legal frame. According to WTO-Plus obligation China promised, proposed improvements to make China's statutes consistent with these promises. Finally this paper reviewed the four sub-systems of China's information disclosure, they are clear stipulation of rights and obligations in information disclosure, public hearing, meeting in the manner of notice and internet application to disclosure manners.
