On The Rule Of Law In The Wto / Tbt And China Improve

With the development of global free trade, the technical barrier to trade in non-tariff barrier plays an important role in international trade. After entering world trade organizations our country has been enhancing the work of lawmaking, law reform and law cancellation to adapt to the rules of WTO/TBT. We have also done a lot work on technical regulations, technical standard, and procedure for assessment of conformity and information and assistance. The technical regulations, standards and assessment of conformity are applied by all contracting parties to eliminate the technical barriers to trade of international trade. The United States has constructed complete system of law in the technical barrier to trade. EU constructed the management system of technical barrier to trade in two layers. The upper layer of the system is composed of authentic directives, and the lower is composed of thousands of technical standards. Japan concentrates on unfair trade investigation procedure and constructed OTO and WTO unfair trade committee to protect domestic benefit. Compared with advanced technical barrier to trade systems, such as the United States and Japan, European Union, etc., technological trade barrier system of China have weak point of letting, await to perfect further. This text attempts to proceed with background that WTO/TBT produces, study WTO/TBT influence to economic trade of our country systematically, use the successful experience of the main developed country for reference, build and put forward the counter-measure and give suggestions for making laws, in order to make our country be adaptive to the technical barrier to trade.
