Technical Barriers to Trade (TBT) are taken by the countries or regional organizations in foreign trade to restrict or prohibit import and export, with the purpose of safeguarding the country, guaranteeing the quality the export Products, avoiding cheats, protecting the lives and health of human beings, animals or the Plants as well as the environment and other legal goals. TBT as a most effective means of trade protection, It has exerted a far reaching influence on international trade. EU is the symbol of regional economic integration and the area contains lots of the developed capitalist countries. Its scientific and technological level is self-evident. EU is recognized TBT leader , the policy, decrees and regulations of EU have a important role to the international market. These measures will have an impact on goods, services and investment of other countries or regional organizations into its market. This paper based on a large number of documents and papers about the problem of TBT , which are existing our trade with the EU. The paper collect lots of regulations, legislative decrees and policies about the field of agricultural, textile, chemical industry, electronic industry. It analyzes the present situations of TBT in China, discussed the technical regulations, standards, conformity assessment procedures in our country, points out existing problems and make recommendations to improve.The paper is divided into four chapters.Chapter one analyzes the background and the reason of TBT. In fact, At present, there is no clearly defined on TBT. The author defines it. Technical barriers to trade has characteristics of the diversity, complexity, hiddeness, duality and so on. the main manifestations of TBT, including technical regulations, technical standards, conformity assessment procedures.Chapter two mainly discuss the system of the technical barriers to trade of EU. This chapter is composed of two major parts: the first part is the offensive measures of EU; the second part is the defensive measures that Trade Remedy System of EU. These two constitute the EU technical barriers to trading system perfectly.Chapter three mainly discussed the EU technical barriers to trade impact on China. Generally speaking, can be said that both opportunities and challenges. On the one hand, it impact on China's export trade, the competitiveness of enterprises, resulting in a trade dispute; On the other hand, it promote our Enacting and improving rules and regulations, accelerate reform the industrial structure, improve the product quality, optimize enterprise structure accelerate the enterprise survival of the fittest.Chapter four mainly expounds the legal countermeasures. Chinese frequently encountered technical barriers to trade caused by many reasons, some of the EU deliberately reasons. Some are our products reasons. "Made in China" there are many drawbacks. For example: quality problems, lower science and technology content, dim consciousness of brand .But our country's legal, supervision, is still not perfect, causing it offered a chance for technical barriers to trade. Author put forward corresponding countermeasure from the angle of the government, industry associations, enterprises Trinity. And mainly expounds the legal countermeasures. China should learn from the experience of developed countries, study their system of technical barriers to trade, combined with the actual situation of our country set up our own system of technical barriers to trade. And give a bit of personal opinion for Resolution Policies of TBT from two points of view of domestic law and international law.
