The right of reticence, as an important system which confines the nation's right and ensures individual's right, has long been established in the west. The establishment of the reticence right takes as it basis the developmental maturity of civic society. However, the integrated social structure makes impossible the emergence of reticence right, due to the superposition of the state and the society in ancient China. Currently, great changes have taken place in Chinese social structure. And the civic society starts to take shape, which requires the establishment of reticence right system. In the meanwhile, its establishment, as symbol which signifies the advancement of social civilization and the self-perfection of independent personality for human beings, will definitely be a milestone in the process of rule of law.
