china's notary system witnessed a fundamental change in its legal status since 1990s with the advent of a new tendency of china's notary system reform and theoretical research on jurisdictional competence. The change, however, does not impair the essence of public right with regard to Chinese notary power. The notary power is closely interconnected with state public right from the outset. Any theory, including the theory of notary system, is by no means invariable under different social condition and social development needs. The notary system has to meet the needs of a real world and build a theoretical frame for it. Under the condition of market economy, a tendency to weakening government function and socialization of state non-compulsory power dictates an inevitable socialization of notary power as part of state power. The nature of public right in relation to notary power does not change with the socialization of the organization structure of a notary authority. Only an organic unity of notary power and the organization structure of a notary authority can contribute to the sound development of notary systems.
