Cycle Economic Model Of Corporate Environmental And Social Responsibility Legalization

This paper includes five parts: the foreword, the academic analyses of the corporation's social duty on the ground of circular economy, the legalization of the corporation's social duty and its system design, and the conclusion.The foreword expatiates the practical significance of the definition and the research of the corporation's social duty on the ground of circular economy. And it also advances the innovative idea how to make conformity of the legalization of the corporation's social duty.The first part and the second part introduce the social duty and the environmental social duty that the corporation should bear in circular economy in detail, and explain its material content and form.The third part is the most important portion of the paper. This portion analyses how to bring the environmental social duty of the corporation into the legal system from a point of view of legal art. Firstly, this portion explains the connection and the deference between the legal liability and the social duty, and then, analyses the necessity and the feasibility of the legalization of the corporation's environmental social duty. By discussing the lack of the corporation's duty in substantial law, this portion describes the design of the legal system of the legalization of the corporation's environmental social duty on the basis of the research of feasibility.The fourth portion advances three approaches to implement the legalization of the corporation's environmental social duty: the circle inside the corporation, the circle between corporations and the circle in social region which on the basis of the extension of production. The innovation of this paper is the matting of system design in the legalization of the corporation's environmental social duty by the precise and logic analyses. On the lay of inside circle, the law system includes environmental tax, environmental subsidy, the corporation disposal and callback of waste and cleaning production. On the lay of the circle between corporations, the main systems are theemission trading and the utility of renewable resources. And on the lay of the circle in social region, the system includes the extension of producer's duty, deposit, environmental label and environmental account. Meanwhile the definition, the illustration and the work steps are respectively explained. The system design uses the experiences come from other countries for reference, and summarizes the successful legislation inland.In the ending, the conclusion especially advances the aim of this paper. That is, by this research, looking forward to providing a favorable beginning for the academia of the deeper attention and discussion of the legalization of corporation's environmental duty.
