Foundation Legislative Research

It has been a short time since foundation appeared as an NGO in China。Since the first Foundation "Children's Foundation of China" founded in 1981, there is only 25 years. But it develops rapidly. It is the result of the policy of reforming and opening up, economic development, and manifestation of the development of Chinese civil society. Chinese academics for NGO research began in the late 1990s, and they are affected by various factors, most of which are focused on the NGO's role, function values, operation mechanism. The research for foundations as the important form of NGO has only just started, and the special legislative study of Foundation is even little.This paper research and invest the Foundation from the perspective of legislation in conjunction with the current development of Chinese foundation. It depicts the legal environment for the survival of the Foundation, finds the negative factors the affect and constrain the development of the Foundation, analyzes the causes and seeks to address these focus in the legislative level. It explores the legal issues of foundation, finds outdated and pressing issues from a juridical realms, in order to seek benign operation and development of foundation in the rule of law.The full text is divided into four parts. The first part outlined the foundation. The second part was the legislative status of foundation. Part three is of the problems and the legislative analysis of the causes of Foundation. Part four is of the prospective of the legislation for foundation.The aim of building the legal system for the foundation and achieving the system innovation is to clarify and systemize the demand of diversification.
