By use of method of comparing research and historical research, from theAgency theory between the two law systems and considering the history of Chineseforeign trade agency and its relevant regulations, this Article analyses the differentlaw relationship under the foreign trade agency, appoints the existing problems, andgive the author's suggestions about the solution.This article includes three parts, which are the preface, the text and the conclusion.And the text is divided into five chapters.Chapter one 'the agency theory and legislation condition of the two law systems'.Because of the difference of the culture background, law tradition and thoughtmethod between the two law systems, there are dissimilitude's characteristics as well assimilar characteristics in the agency institution. However, along with the internationaleconomy and trade development, the two law systems appear the merging trend in theagency institution. is oneof the most famous symbols.Chapter two 'an overview of Chinese foreign trade agency institution'. Thetraditional foreign trade agency system is a special kind of law system of our country,which is the result with Chinese special feature existing based on the control of the rightfor foreign trade business. The existing law relating to foreign trade agency include and .Chapter three 'the analysis of the every kind of law relation under Chinese foreigntrade agency'. This chapter analyzes the rights and obligations of the person, the agentand the third party under the every kind of agency form, and points out the applicablesituation for the foreign trade agency.Chapter four 'the key problems for Chinese current foreign trade agency lawsystem'. This chapter points out the problems, including the legislation disunity, the mixup of the appointment agency and the contract of appointment, and the problems in the.Chapter five 'the consideration about improvement of Chinese foreign tradeagency law system'. The author suggest that at first the foreign trade agency should beadjusted by the Civil Law in future, secondly the relevant regulations in the Contractlaw should be supplemented, thirdly should be abolished, and finally we should join at appropriate time.
