The employee rights protection in China is weak. Some enterprises pursue profits at theexpense of infringing upon labor rights, which has already become a common social problem andfarmer workers and miner's rights abuses have aroused even more attention. In my opinion, as toemployee rights protection, the key issue to be solved is the strict enforcement instead of lackingrelevant laws and regulations. We can not only rely upon administrative and legal means foremployee rights protection due to the limited enforcement resources. The purpose of this article isto discuss ways for the employee rights protection from a Corporate Social Responsibility(hereinafter referred to as CSR) perspective.CSR refers to the fact that the corporate management should not only consider the interests ofthe shareholders but also the stakeholders including employees, consumers as well as thecommunities whenever they make a business decision. Socially responsible corporate behaviorenhances the employee rights protection. CSR will play a more important role in China'semployee rights protection as the CSR consciousness gradually integrates into the Chinese society.For better employee rights protection, besides paying attention to enforcement andgovernment encouragement strategies, this author lay more emphasize on using the market forcesfrom a CSR perspective which include making full use of the monitoring function of MNEs andNGOs, educating the workers as well as bringing the attorney's role into play. The full play of themarket forces in employee rights protection can save administrative forces and can be asupplement or even be substitution enforcement to a certain degree. All the means are not the end,the ultimate purpose is to induce the voluntary integration of the CSR conscious into corporatepractice and achieve harmonious development of the Chinese society.This article falls into 4 chapters:the 1st chapter lists several employee rights abuses issues andgive a further analysis on the reason for the abuses. These reasons include the blind pursue ofprofits of the enterprises at the expense of sacrificing employee rights, lacking of governmentmonitoring as well as the poor role of the labor union. The second chapter gives the concept andthe revolution of CSR as well as the brief introduction on the practice in western countries andChina's CSR legislation and practice. The third chapter suggests several ways for employee rightsprotection from a CSR perspective. The forth chapter brings a conclusion to the entire paper.
