The thesis introduced the domestic and alien development of institution on inviting bids and bid and the system of legal institution on inviting bids and bid ,pointed out the characteristics of the foreign legal system on inviting bids and bid and the enlightenments given to us.then the thesis made a primary discussion on the relative theory of inviting bids and bid, proposed that the criterion of validity of a contract of inviting bids to purchase should be upon the signing and gave a special—eyed analysis in theory on the bail guarantee happened during the inviting bids and bid. On this basis the thesis mainly analyzed problems in the legislation on inviting bids and bid as problems existing in practical movements as well, and profoundly analyzed the reasons created these problems theoretically. It also raised measures to solve the above-mentioned problems. meanwhile, it aimed at the new challenge and the development tendency of international inviting bids and bid upon China's entrance into WTO and raised basic principle and detailed measures to consummate legal institution on inviting bids and bid in our country.As a important innovation of the Chinese engineering field, the enforcement of the competitive bidding system of engineering has greatly inspired the development of construction enterprises, however ,the compromise in the enforcement of "Competitive Bidding Law of the PRC'and problems in the legal procedures, especially the corruption, has seriously hindered the development of basic system in the engineering field. As a result, in some projects, the competitive bidding system has actually lost its really function, and cost great unnecessary loss to the society and enterprises. this article is trying to discuss the function, importance,problem and solutions of the competitive bidding system in both theory and practicing.It is an move to enact the tendering and contract regulation of civil engineering for construction industry to deepen the construction enterprise reform.
