Citizens The Right To Road Traffic Legal System Research

Traffic is the important condition of the human's society and economic activity. Producing and developing along with the human's economic activity, it plays a significant part in the society and the economy. Along with the development of the social economy, the traffic technology is improved, traffic vehicles and the traffic ways are also appearing diversity, the modern traffic has developed into an organic system including railway, road, aquatic, aviation and communication and so on. The road traffic right is one important right of the citizen's rights. To realize it, not only complete traffic facilities, scientific administration and the whole citizens' traffic consciousness are necessary, but also complete traffic laws and regulations should be indispensable. This article focuses on the citizen's road traffic right and the research of legal institutionThe thesis is divided into three parts, the first part is analysis of the connotation and the characteristics of the traffic and the road traffic right. Road traffic right is citizen's the freedom degree that they legally shares during traffic activity at a certain time in a certain space including characteristics of relativity particularity of the duty and morals, it can be classified according to different standards. The modern citizen road traffic right is a right system covering many concrete rights.The second part is to elaborate the evolution of citizen's road traffic right, pointing out the citizen's road traffic right has experienced a long evolution process from a natural right to the legal right. Influenced by the feudal rank thoughts of the rule order maintenance, road traffic right in the feudal society is with history characteristics of limited narrow scope of traffic participants and unequal distribution of traffic resource. As a series of traffic laws and regulations were issued by Kuomintang, the citizen's traffic right protection was neglected. In comparison, the west developed countries have established modern traffic laws institution persisting on guiding concept of "humanist", emphasizing the protection of the potential weak group and traffic safety education, positively developing the public traffic , thus citizen's road traffic right is fully realized.
