E-commerce is a new economy form based on science and technology, which can determine their own economic characteristics, thus affecting e-commerce law. In principle, all provisions of GATS are applicable to all e-commerce, however, e-commerce can be not shaken off as a new economic unique, except for comprehensive application of GATS in WTO to resolve legal issues of e-commerce, several aspects need to make appropriate adjustments. These include: classification of e-commerce, MFN and transparency, internal regulations conflict, e-commerce competition, market access and national treatment, tariff, intellectual property, particularly basic telecommunications cared about by members of the general has been a problem plaguing. From 1995, the countries of the world and international organizations have made remarkable progress in the e-commerce legal issues, and our nation is also gradually improving e-commerce legislation. With the efforts from the world, WTO legal system will inspire more perfect.
