Personal Credit Research Consumer Information Privacy Protection Laws

Nowadays the construction of the personal credit information collection system is in vigorous process in China.However, the systematical law researches into how to protect the personal privacy in the personal credit information collection activities and how to construct the legal system of the protection of individual information privacy are comparatively rare. Therefore the thesis discusses how to protect the rights of information subjects in these activities.This paper consists of four parts,the first parts is the preface which shows the major issues to be discussed.privacy protection in the process of personal credit collection.This part points out that the protection of personal privacy is highly important on the analyse of the whole process of information current.Even it can be said that the protection of privacy in the process of information publicity is the key problem which can determine the success of the construction of credit law.The second part is chapter one and two,analyses the basic theory of credit collection and information privacy.Chaper one introduces the personal credit reporting,it contains two section.The first section introduce the definition of credit,the signification and necessary of credit reporting.The second section introduce the development of personal credit reporting in China.Chapter two mainly introduce the essence theory of information privacy.Section one,the author discusses the foundation of privay and the meanings of privacy.Section two mainly discusses three issue.The first is the four characters of information privacy in the system of personal credit reporting;The conflict between credit reporting and protection of privacy;The necessary of privacy protection in credit reporting.Part three is chaper three , introduces the law practice of the legal protection of right to privacy in credit reporting system abroad. The United States and Europe have perfect credit reporting law system ,so these countries are called"credit country". The United States and Europe have different environrment and culture,the law of privcy protection is also very different.Section one, the author shows the legal protection of right to privacy in credit reporting system in United States.
