The Jurisdiction Of The Electronic Contract Research

Jurisdiction dispute is an important problem that an electronic commerce dispute shall solve in the first place. While under the internet circumstance, the traditional jurisdiction rules are confronted with great challenges. This dissertation is written in order to figure out a way thereof, and thus help the E-commerce developing healthy and rapidly in our state. Firstly, in this article, the conception of E-commerce and electronic contract and the other related conceptions are described. Secondly, the problems arising from the application of the traditional jurisdiction rules in the electronic contracts are discussed. Thirdly, the popular theories and ideas about the jurisdiction basis over the E-commerce are described and criticized, including the"minimum contracts"and"long-arm jurisdiction"and its new judge standards, the"forum non convenience"and its application in our state etc. Finally, the international-wide legal practices and national legal activities in the field of E-commerce jurisdiction are described.The remarkable feature of this dissertation is: making comparison and analysis to the most important theories and ideas of the jurisdiction basis of E-commerce dispute, evaluating fully the possibility thereof to solve the problem of the E-commerce jurisdiction dispute in our state.
