The civil right of access is one of the basic democratic rights. To guarantee the civil right of access is not only the respect to human rights of citizens, but also the necessary condition to the healthy development of a democratic society. After World War II, many countries have formulated their laws on administrative information publicity to guarantee the civil right of access. Though great progress has been made in this regard since the adoption of the policy of reform and opening up, constitutional status of the civil right of access has not yet definited and not yet formed a legal system and a sound system. Therefore, the author begins with the basic theory of the civil right of access, and then sum up the foreign good experiences and practices, considering the present state of the civil right of access, points out the existing problems and their root causes. Finally, the author presents her views and recommendations on how to establish and perfect the system of the civil right of access.The full article consists of three parts. The first part is the brief introduction of the civil right of access. This can be explained in six branches: first, the concept of the civil right of access. Now, a lot of papers and monographs have mentioned the right to know, it almost has the same meaning with the civil right of access, but I think the civil right of access can express that the citizens can obtain government information without interference from the public powers, and when the civil right of access improperly rejected, the citizens have the right to request the court to grant relief. Many scholars think the definition of the right of access has a broad sense and narrow sense. This article focus on the narrow perspective of the concept, namely, the right of citizens to access information of the government. Second is the corpus and the contents of the civil right of access. Third is the nature of the right of access. This article regards the civil right of access as one of the social rights of citizens, which should have certain civil rights nature, and which should be a basic human right of citizens. Fourth is the research of contrast between the civil rights to access information and related concepts such as freedom of expression and the right of participating Political business. The fifth, there are a lot of regulations in foreign countries about the civil right of access to information, this article draws a summary of good experience from countries such as USA, UK, Sweden, Japan and South Korea.
