Network Domain Name Dispute Settlement Mechanism

Domain name is a perfect combination of electronic technology and information technology. With the popularization of the Internet, it has been provided with some legal features, such as the quality of sign, of unique, of rareness and of worthiness, which have been recognized by public. As generally used business identifiers, it has been provided with images of enterprises and business reputation. Because it is not allowed to have the same domain name on the Internet, the dispute has heated up driven by interest, for example, they have lined up to registered the domain names, and because there are more disputes between the domain name and brand name. Now more protection methods have been listed on the legal schedule.On the previous part, we have introduced the origin of the domain name, rule of naming, feature of law, and the condition analyzing and cause information of the domain name registration and dispute between domain name and brand name.The dispute of the domain name has appeared earlier in overseas than in China, therefore, more experience both in theory and in practice has been accumulated there. On behalf of British-American Law System and Continental Law System, the UK and the US and Taiwan Region of China have been chosen as the examples to clarify the dispute solving regulation and mechanism in the real cases. Then, based on the domestic solution conditions, the current law should be adjusted when the relevant dispute happens in order to have law to protect domain name-the burgeoning object of intellectual property.
