The Petition System Is Modern Basic Research

People's Complaint letters and visits, as a political system with a long profound history and social basis in China and for people to participate in politics and express their opinions, play very important role in bridging the interrelationship between our country and people through different historical stages. The dramatic increasing of letters and visits activities breeds from the rapid growth of our economy, the continuously accelerating modernization progress of our political system, the wake of right consciousness and subject consciousness of our people and the fierce social conflicts. Confronted with many contradictions and exceeding expectations, letters and visits system appears to be insufficient to resolve problems and unsuitable to the requirements of development in this era. Letters and visits system is facing the critical decision of where to go and nowadays its reform has obviously turned into a hot issue concerned by our country and society.However, the academic study of letters and visits system is not in proportion to its extraordinary importance. Either in the research on disputes-resolving mechanism or on administrative remedy system, lettering and visiting is on the verge or has never been acknowledged at all. Though some experts and scholars sometimes has never mentioned letters and visits system in their essays or books, this realistic system functions importantly in our political and social life, which has been experienced by tens of thousands of citizens annually and affects numerous people. How could that system keep its vital force and continuity during decades of years? About this question, this article endeavors to deeply research the political and legal traditions beyond letters and visits system to find a proper explanation; to systematically study letters and visits system on constitutional perspectives so as to exploit the way out for this system; and to promote the modernization reform of letters and visits system advancing with the times and to promote the construction of a harmonious society such that this traditional system may radiate new vigor and vitality through system innovation.On the basis of the above contemplation, the author adopts the research approach of resource reference, historical study, surveys and visits, logic reasoning, comparative analysis, inducing and deducing method and so on. Through deeply research on the letters and visits system of China, the author defines the development courses of letters and visits system and main characteristics of its evolvement, concludes and learns from historical experience and discusses the relevant factors constraining that system from developing and recent implement and strategy of that system reformation in our country. Based on learning from the ombudsman system of the western countries and according to the current situation of China, this article proposes to establish the solving mode for letters and visits which will be conducted by the supervision specialists of National People' s Congress within the frame of NPC and provides theoretical support and referential path to reform letters and visits system in China.
