Study Of Open Government Information Legal System

Disclosure of government information has become an important element of democracy and rule of law in the age of knowledge economy and information along with the world tendency for establishment of the legal system regarding freedom of information. In China, some progress has been made in this field; however, the legal system of disclosure of government information has not been established yet. Therefore, disclosure of government information is a new issue for the research on the science of administrative law, and requires further study. By dating back to its popularity all over the world and the legal system overseas, this essay researches on the theoretic basis of disclosure of government information, including the basic concepts of the subject. We also do researches on the compositions of disclosure of government information legal system, including its basic principles, the subjects, the scope of disclosure of government information, the procedure for disclosing government information and the means of remedy for the right of assess to government information. Then on the analysis of the current situation on disclosure of government information in China, we discuss the barrier and the necessity for us to build our legal system on disclosure of government information. On this basis, we make some suggestions for the establishment and improvement of legal system of disclosure of government information in China by profiting from western developed countries in order to make them perfect.
