Therefore, this article is for the purpose of doing some exploration and research on the E-Business security supervision and management.First of all, the author has analyzed all kinds of security problems that exist in the E-Business. The author believed that, on the E-Business security category side, E-Business has serious security problems in the hardware system, the software system, and the network system; on the E-Business security threat essence side, E-Business also has serious security problems in system movement, in information security, in subject confirmation, in acknowledgement of transaction behavior and content objection and in the civil evidence's legal effect of E-Business's security technology method. All kinds of security problems have restricted the development of E-Business seriously.And after that, the author has analyzed challenges that the E-Business security problems bring for the present law deeply. On the foundation of profound understanding of E-Business security problems, the author proposed that the E-Business security problems challenge the present law mainly in three aspects: the electronic signature to the existing signature law system, the electronic authentication to the legal blank, the electronic payment to the present payment law system. And the author carries on the elaboration on the challenge of electronic payment to traditional law from the electronic currency, the electronic check and the credit card paying on-line. The E-Business security problems bring in serious supervising situation, which urges the country to take the relative measures.Then this article has analyzed the advanced international legislation experiences and the concrete operation patterns in E-Business security supervision and management. The author thought that the international organization and other countries have advanced legislate experiences in displaying the international organization's leading role, constructing the mutually supplementing and promoting legislation pattern between the government and non-government, clarifying the basic idea of E-Business security transaction, placing great emphasis on expert's function, establishing generality first and particularity second train of legislate thought. Moreover, the author has got some enlightenment such as having realized E-Business security supervision and management was an item of systematic project, persisting the technical neutrality principle, localizing the government and the profession organization's role in E-Business security supervision and management, bringing in line with international practices, paying attention to the protection of the network right of privacy through the analysis and the comparison among the American's primary profession autonomous and special legislate supervision and management pattern, European Union's strict legislate supervision and management pattern, and the Global Commercial Alliance's total profession autonomous pattern.Finally, on the foundation of overseas' advanced experiences, the article proposed certain suggestions on E-Business security supervision and management of China. The author thought we should strengthen the legislation construction in E-Business security supervision and management, and found our own E-Business security supervision and management pattern gradually. And the author proposed consummate E-Business security supervising and managing legislations through formulating electronic E-Business law,establishing basic principle of security transaction, amending certain present laws and regulations, consummating network security laws and regulations, electronic signature laws and regulations, third party authentication organization system, electronic payment standards. And the author also proposed that, to meet the society need, the government should strengthen security supervision and management in computer, telecommunication and Internet, in the on-line operating behavior and in the electronic payment. Because E-Business security supervision and management is a huge systematic project, our country should follow the main train of thought of "union supervising and managing, network supervising and managing, transparent supervising and managing, service supervising and managing, legal supervising and managing". Along with the development of the market economy and E-Business and the transformation of government function, we must fully know and display profession organization's autonomy assistant function.
