The Company's Lawyer System

In the process of socialism modernization, China's corporate lawyer system continues to developed and improved with China's legalization and corporate modernization. Maybe corporate lawyer system is not that illustrious within the magnificent scene of socialism modernization. It still can reflect the ups and downs in the process of China's modernization just as a dewdrop's shine can reflect the brilliantness of the sun.In 2002 China began to build up corporate lawyer system. Many large-scale enterprises benefited a lot from the piloting project. The country also accumulated rich experience to promote corporate lawyer system. This paper starts with the company attorney system. On the basis of introducing the fundamental situations of company, this paper will do a comparison between the company attorney and the other jurally personnel, and then does a further explain about the rights and obligations of the company attorney. On the process of evaluating the foreign attorney, this paper will try to find out the necessity and feasibility of establishing the company attorney system, to the effect that table a proposal of perfecting the company attorney system of China on the basis of the existed company attorney system.It is not a long time that the company barrister system existed and developed in our country,Therefore, this article is a good attempt not only in the selection of topic, but also in the angle of research as well as the research technique. After the author collect the detailed information he made some instructive exploration in company barrister system: On the contents, this paper analysis the lawyer system's main condition, the lawyer system and corporate of our company comparatively, the development and trend of lawyer system in foreign companies, try to find out the necessity and feasibility of establishing the company attorney system and how to improve our system of company attorney. In this paper ,it gives us a comprehensive and systematic introduction and analysis.On the logical structure, the five parts of this article, according to hierarchical logical order going forward, seek for experience in the process of foreign company lawyer system's development on the basis of explaining the company lawyer system and related issues, thus excavates the necessity and feasibility of establishing our country's company lawyer system, and with end put forward suggestions for constructing and improving the system in our country. Compared with the academic theses of the same kind, this article is better in clear line of thought and logicality.In rationalization proposal,the author have reformed and improved the company lawyer system mainly from the two sides: One aspect is to find the problems which are in the process when establishing the company lawyer system. The second aspect is reform and improves the system which are of three points: This article proposed to standard the company lawyer employ system, promotion system and title, also company should improve lawyer's station and lawyers should increase the professional ability by themselves.As a whole, this article has put forward the idea about the company lawyer system that hasn't shown by other articles in similar .It's the important point of this article.Of course, during this period of finishing the article, maybe there are some materials the author hasn't collected. But the author whish the experts can give some advises about the logical structure of this article and the personal idea of the author, for further study and complement to fit for company lawyer system reform.
