Non-government organizations experienced significant development in the world since 1970s. Some scholars call this trend "a global association revolution" and regard it as equally important as the emergence of national countries at the end of 19th century. As a part of this global trend, non-profit organizations have been developing in a fast pace in China since the reform and opening policy is taken.Modern society is the society ruled by law and the administration of non-government organizations should be deal with by laws. China has also issued relevant rules, such as Regulations Regarding Registration and Administration of Social Organizations, Interim Regulations Regarding Registration and Administration of Private Non-enterprise Units and Regulations of Registration and Administration of Funds, the general situation is that the legislation is not enough, with more restriction and administration than support and regulation, which limits the establishment and development of non-profit organizations. The prosperity of non-government organizations in China poses a challenge to the existing legal system. How to further reform and improve laws and regulations governing non-government organizations and incorporate the management of non-government organizations into the legal framework is an issue we face at present and in the future.This article analyzes the meaning, characteristics and the function in legislation of non-government organization, probes into the existing problems and environment of the Chinese legislation and attempts to put forward a few suggestions on how to improve the non-profit organization legislation. These measures conclude that to establish NGOs' recording system, to reform dual management system, to construction and improve the law system about the non-government organization in the fact of restricting the personal interest, revealing the information and soliciting contributions. Finally, in the legislative form, the government should have a clearly stated financial support and tax subsidization policy to non-governmental organizations.
