Perfecting Administrative Benefit The Legal System

All-sided constructing well-off society during the first 20 years of thiscentury was brought forth in the 16th conference of The Communist Party'scongress. It is a significant point that the society becomes more harmonious.As we know, the key point of constructing harmonious society is to set ajustice society where people get well along with each other. However, theserious gap between the rich and the poor as well as the shortage ofknowledge becomes the obstacle of reaching this goal. Administrativebenefit is a very important means of solving the social poor colony'sproblem. Overseas, as an important part in the Social security system, Administrative benefit has been relative ripe. The scholars in our countrypay less attention to administrative benefit, and lack the ripe theoreticaldirection; therefore, there are many questions in the implementation. Thisstatus violate the goal of constructing harmonious society which our countryalways pursuing. At the same time, it is not accord with the mode of serviceadministration. The aim of this thesis is to find the problems ofAdministrative benefit at present through such research methods ascomparable analysis and historical analysis. This paper also attempts to set auniform "Administrative Benefit Act" and is hoped to be useful to thedevelopment of administrative benefit theory. This paper includes six parts.They could be introduced as follows.Introduction: bring forth that the reason of researching administrativebenefit is response to the demand of harmonious society and serviceadministration.The first part: expound the basic acknowledge and meaning ofadministrative benefit. This part divided into two portions, the first portiondefine the connotation of administrative benefit: administrative benefit is akind of administration of providing the those people who accord to somestandard with some goods or material benefits by government. Its purpose isto protect the survival and development of people and organizations.Meanwhile, the styles and characteristics of administrative benefit are mentioned and the constitutional basis is also pointed out. In the secondportion, the writer discusses the theoretical and practical senses to ourcountry and explains its functions to achieve the social justice constructharmonious society and consummate the theory of administrative law.The second part: review the development status of administrativebenefit system under different administration modes and in differentcountries, concludes their common ground and find its use for reference toour country. This part also includes two portions. The first portion discussadministrative benefit under the condition of order administration andbenefit administration and make conclusion that the consummation ofadministrative benefit relates the transfer from manage administration toservice administration and expanding of the acknowledgement of humanrights. The second portion compares the administrative benefit system inBritain, the USA, Sweden and Japan.The third part: address the development status of administrative benefitin our country. The writer has recommended some practice thatadministrative benefit nature in history of our country at first. Secondly, expounded the fact of the administrative benefit in our country in the currentsituation. Then pointed out the weak point of the administrative benefitsystem in our country.The fourth part: this part is some reflection and suggestions to theproblems mentioned above. Firstly, consummating the goals and basicprinciples of administrative benefit in theory. Secondly, perfecting theadministrative benefit system in practice. At last, making efforts toconstitute "Administrative Benefit Act".The conclusion: the writer have made summary to the whole paper.The main innovation of this thesis is that considering administrative benefitshould be extended in the aspects of contend and object, analyzing theinfluence of administration mode to the development of administrativebenefit and making efforts to constitute "Administrative Benefit Act".
