The core of "Three Rural" problems is land. The solution to the "ThreeRural" problems depends on the development of land system and related policies.The land problems are closely associated with the Rural Collective Landownership. Therefore, the research on the problems makes great sense. TheChinese present rural collective land ownership system has deadly flaws and theflaws make the Chinese present rural collective land ownership get into thesevere dilemma of system. It severely sets obstacles to the smooth social andeconomic development. The reform on Collective Land Ownership Systembecomes a consensus in the theory field, there are different opinions onreformation and consummation of national collective landownership system inthe academic circles, including the reservation and perfection of Collective landOwnership, Upholding national collective land ownership or canceling it to carryout private ownership or Nationalization of Rural Collective Land or weakeningthe rural collective land ownership or coexistence of different ownership and soon. History is a mirror of the present. We must have in-depth knowledge andthinking on the evolutionary history and the current situation of rural land systemso as to establish a brand-new one. Examining the history, analyzing the statusquo and searching for the causes are for the purpose of furthering theunderstanding of rural collective land ownership. The thesis makes anexplanation and analysis respectively on the reform mode, hoping to seek waysto the rural land reform mode that is suitable to the conditions of China,including the dual social security structure and conflict between increasingpopulation and dwindling land. The basic conditions of China make us have toexamine the following factors: the coordination of ensuring food security,maintaining social stability, market process, building of social security system;gradually pushing for the nationalization of rural land in a prudential way.Pursuant to the aforesaid factors, this article believes that the establishment ofNationalization of Rural Collective Land Ownership is indispensable to solvemany of the economic and social problems of our country at present and thatperfecting rural collective landownership or canceling it to carry out privateownership project cannot be adopted in accordance with national conditions. The thesis claims that our country should stand for breaking with the local publicsystem on the rural land lawmaking mode and establish Nationalization of RuralCollective Land Ownership.The thesis becomes separated into three parts. There are 35000 Chinesecharacters.PartⅠ: Making more detailed and deeper analysis on the history and thestatus quo of the Rural Collective Land Ownership. This section examines thecurrent situation on the historical basis. Looking back on the transition of ruralland ownership in China,a conclusion can be drawn:historically,the evolutionof rural land ownership in China is in nature a process of increasingimprovement on the separation of ownership and using right based on thenational land ownership in which national land ownership plays the dominantrole. By exploring the current situation, we can find that collective landownership in China falls into a plight seriously. It comes to the conclusion thatthe existing system is attacked by the problems of stereotyped form.This thesis believe that the deadly flaw of the Rural Collective Land Ownershiplies in the absence of subject of the rural collective land ownership in terms oflaw and practice.PartⅡ: Making more detailed and deeper analysis on the phenomenon andthe causes of the dilemma. The systematic problem in China's rural collectiveland ownership lies in the absence of subject, which is comprised of the extrinsicproblem and intrinsic problem resulting from the imbalance between publicinterests and private interests and building and functioning of socialist marketeconomy system which exacerbates China's innate contradiction in revalcollective land ownership.PartⅢ: Anatomizing the modes of reforms: this part encapsulates the mainviews in China's theoretical circles and delves into the merits and demerits of thereform modes and their system risks respectively.PartⅣ: Making more detailed and deeper analysis on the best solution to ruralcollective land ownership. The thesis proves the necessity and possibility ofnationalization of rural land ownership and sets forth the guiding thought andgeneral principles for the establishment of the nationalization for China's collective land ownership based on the national conditions.. In this part, theauthor gives more space for the modes of nationalization and designs three stagesfor nationalization,namely, nationalizing the rural land and allowing permanentcontracting, nationalizing for leasing, managing nationalized land by companies.The above-mentioned nationalization modes not only satisfy the requirements ofthe state system benefit but also let the people share the achievements of thereform, what's more, better resolving the long-term-besetting contradiction inChina between dwindling land and agricultural modernization, urbanization,industrialization and realizing the successful combination of public landownership and market economy,and also address the clash between equity andefficiency.
