SA8000 (Social Accountability 8000 International Standard isabbreviated as SAI) is the first international standard that can beauthenticated by third party, which is established by SAI (SocialAccountability International) based in America. The standard is drawn up onthe basis of ILO Charter, United Nations Convention on the rights ofchildren, Universal Declaration of human rights and so on. It includes ninerespects involving children labor, mandatory work, health, security, rights offorming associations freely and collective negotiations, discrimination,exemplary measures, working time and work wages, etc.SAS000 causes intense echo internationally once passed through.Different circles have different judgments on it, unable to decide which isright. On this question, the text is divided into three parts besidesintroduction, conclusion. And it elaborates and analyses questions such as thebackground of SA8000, main content, characteristic, legal attribute, futuredevelopment and so on. At last, it proposes law measures according to thesituation of China.In the first part of the thesis, we introduced the background of SA8000,main contents and characteristic. Analyzing SA8000 in background ofeconomical globalization, we think SAS000 emerges in the tide that themovement of corporate social responsibility and the movement of producingregulations in transnational corporations spring up in large scale. Althoughthis maybe a substantial choice when developed countries fail in puttingsocial clause into WTO temporarily. The former is main. SAS000 reflects thenecessity of the development of economical and society in modern times. Weclassify the article' s main contents into four respects such as core laborstandard, working time, wage, health, security and management system andbriefly introduce them. Basing on this, the article explains the distinctivequality of SA8000 by comparing with producing regulations of transnationalas well as ISO system.SA8000 is analyzed in law knowledge in advance in the second part of the thesis. Now that SA8000 has no legal value, it should be considered asinternational folk authentication standard. Considering that, the author thinksthat SA8000 has is not a trade barrier by comparing with the definition oftrade barrier made by commercial department and analyzing the benefits ofits contents. Temporarily developed country could not give SA8000 legaleffect to restrain import products. But it is possible to put it into ISO andWTO to make it compulsive. We should put emphatically attention on this.The legal influence and countermeasures about SA8000 are in the thirdpart of the thesis. The author thinks we should learn from SA8000,international labor convention and consider Chinese conditions to improvelabor laws and measures. More over, we should establish Chinese socialresponsibility standard and realize the localization of SA8000. Meanwhile,the condition that labor laws are not carried out strictly should try their bestto create looser international trade environment as well as protect laborer' srights better.
