Sports Agent Legal System

The accession to the WTO of our country and obtaining the right to hold Beijing 2008 Olympic Games, and the gradual setting-up and improving of socialist market economy, all these bring good opportunity to development of the sports industry of our country, and excellent chance of historical development that the brokerage of sports as one of industry's main body of sports happens too. But because of the restriction of the sports system now, the immature legal system and the management defect, our country's sports managers'market is quite confused and has some serious problems which need to be solved at once, such as managers intuitions of different level of qualities and their employees lack of profession moral and so on. These defects not only has influenced the overall image of the sports broker seriously, but also destroyed the normal order of sports managers'market, influence the development of the whole sports industry. Therefore, it must have a very important social meaning to research profoundly on the issue of construction of sports brokers'legal system. This thesis defines the sports brokers, analyzes the state of sports brokers, points out the necessity and urgency of constructing the sports brokers'legal system, then puts forward some suggestions on how to regulate our country's sports brokers through drawing lessons from foreign sports brokers'legal system.This thesis is divided into four sections.Chapter one is the sports brokers'summary .Through the introduction of the definition of brokers and sports brokers, this section puts an emphasis on introducing the classification of sports brokers, analying their characteristic and position, then discusses the meaning and influence of sports brokers to the whole sports industry ,and analyzes the causes of preventing sports brokers from healthily developing though the analysis of the state of sports brokers.Chapter two is the introduction of the establishment of sports brokers'legal status. On the basis of the discussion of the sports brokers legal status, this section explains the rights and obligations of sports brokers, then analyzes the legislative system of sports brokers of our country and its existing problem. At last, it researches profoundly on the necessities of constructing the legal system of sports brokers.Chapter three is the introduction of foreign sports brokers'legal system. On the basis of the analysis and research of the legal system of the sports brokers of international sports organization ,America and Europe,it makes a comparison of them and concludes their experience. All of the experience have important implications on our China's regulating the sports brokers.Chapter four puts forward some suggestions on regulating our China's sports brokers. From the viewpoint of"law regulating, government supervising and trade self management", I put forward some suggestions on how to make perfect our China's sports brokers. First of all , I propose improving sports manager's market access system. Secondly, I put emphasis on standardizing sports manager's contract. Thirdly, I research on the formulation of sports brokers'commission and earnest money. Finally, I define the sports brokers'legal liability.
