On Perfecting The Legislation Of Social Security Of Farmers

In our country, strengthing the legislation of social security ofland-losing farmers has practical necessity.One reason is that thesurvival condition of land-losing farmers is not good and needimprovement immediately, the other is the legislation about it isbehindhand and sould be perfected. Strengthing the legislation ofsocial security of land-losing farmers should not only put up the rightidea, respect human rights and be people-oriented, but also hold therational principles such as:the principle of regulating in accordancewith law, the principle of localization, the principle of uniting equityand efficiency, the principle of linking up with the legal system ofsocial security in existence, the principle of government-oriented.Intheory, the modes of social security of land-losing farmers couldinclude the following three:rural social security system, applying theurban social security system selectively, social security systemespecially for the land-losing farmers.These three modes don't havehigh compatibleness in practice, so we should choose an ideal mode-agovernment-oriented social security system for all land-losingfarmers.Seen from the legislative mode, the mode of combining lawswith special policies which we're using now is not appropriate,becauseit can only take temporary solution but can' effect a permanentcure.The ideal legislative mode is to constitute and perfect thelegislation at three levels,the first level is constituting basic law ofsocial security, the second level is constituting social security lawespecially for the land-losing farmers,the third level is perfecting thelaw of land requisition, compensation and allocation.The legislation ofthe second level includes: establishing the basic old-age securitysystem of land-losing farmers;perfecting the medical insurance system of land-losing farmers; perfecting the employment securitysystem of land-losing farmers;establishing the minimum standard ofliving system of land-losing farmers; establishing social security fundof land-losing farmers; establishing a strong implement institution.
