Civil rights of college students discussing in this article is mainly the rightswhat the college students have based on the college students' status related to thecollege, which concretely mean the legal qualifications of college students whowill implemented certain behavior or achieved certain interests according to thecivil laws. The relationship which we have been speaking between the collegeand students reflects one kind of administration legal relationship withmanagement and obey, because of the influence of the original planned economysystem and college management system, which characterizes that the collegemanagement to students mainly carries on through the administration way. Withcollege organizational reform implementing in our country, the relationsbetween college and students are partly attribute of civil legal relationship whichhas been increasing gradually, in addition to continuing partly to keep a certainadministration relation. At present, what civil legal relationship between thecollege and students contents still exists many ambiguous place. It is necessaryto dissect the civil legal relations between students and colleges and definitecivil rights and obligations between colleges and students, on the foundation ofwhich we should actualize the effective protection of the college student's civilrights. College students as ordinary citizens enjoy general civil rights in civillaw, which mainly include the right to life, the right to body, the right to health,name of right, portrait of right, the right to privacy, the right to defamation, theright to honor, freedom of love and marriage, reproductive rights, sexualautonomy rights, the right to freedom of life, property rights, intellectualproperty and so on. The specific civil rights enjoyed by college students asstudents principally comprise the right to get study opportunity, the right to gainstudy condition, the right to obtain the fair appraisal and results, the right toreceive record and academic degree certificate, the right to attain employmentguide, the right to know the correlate information and so on. In order to protectthe civil rights of college students effectually, we should definite the civil rightsof college students and college management authority to the students and itsprocedure in the education laws and regulations, and further improve civil rightsrelief ways, which mainly include establishing the education arbitration systemand improving college students complaint system and civil actions disposingcivil disputes between colleges and students.
