Employment discrimination broadly exists in our society. It not only infringeslabor rights, including employment rights and other related rights, but also goesagainst the constitutional principle that every citizen is equal under the law and legalprovisions. What employment discrimination is, the employment discriminationconcrete behavior manifestation of in our country, and legislates question inemployment discrimination and such three problems are the goals which the researchof the article wants to realize.Foreword mainly explains the history background of the cause of employmentdiscrimination in China, and the lacks of present law in employment discrimination,discuss the present research on employment discrimination in China and foreigncountries. Finally get the issue of this article.Chapter one sets forth the basic theory of employment discrimination, its contentmainly includes the definition of employment discrimination, the analysis of basictype of employment discrimination, and the impair of employment discrimination.Chapter two mainly takes research on present employment discriminatorypractices in China and the legislation problem. Gender discrimination anddiscrimination on residence requirements are the common discriminatory practices inChina. Legal is the common method to eliminate the damage of employmentdiscrimination, but now the present laws of China have many shortages, such as thenarrow definition of employment discrimination, and lacks of regulations in legalremedy agency, remedy procedure and legal responsibility. All this cause the victimcan not protect themselves by law.Chapter three gives some suggestions to the law system of employmentdiscrimination of China according to analyzes of chapter two and learning from theexperiences of other states regarding employment discrimination. In legislativeimprovement, first we should give a clear definition of employment discrimination;second, found a special institution to help people who have been discriminated. Present law and document involve lots of employment discrimination regulations, thisall need to clear away. Of cause, we also need a organism to solve the problem.
