Jurisprudence Thinking Of Building A Civil Society

Since China's reform and opening up, a relatively independent civil society is rising up with the development of society and the increase of people's awareness of democracy, which has influenced to society's political economic life deeply. The subject on how to consummate and develop the country's civil society has attracted more and more attention from the entire society.In view of the present situation in which the country's civil social development has just started and civil social organization legislation is imperfect, the thesis proposes to consummate legal construction of our country's civil society to provide legal protection for the civil society organization's self-government and self-discipline. The thesis proposed to step up the formulation of related laws and regulations based on China's national condition, so that the government could actually carry out the civil society's construction. Through this way we can realize the harmonious development of society.This thesis discussed the legislation question of construction of the Chinese civil society thought of jurisprudence in four chapters as followed:In Chapter 1, this thesis summarized the concept of civil society. Firstly, it has introduced definition and legal characteristics of civil society. Then, it has discussed the modern city society theory origin.In chapter 2, it introduced current situation of the development of our country's civil society and its obstacles. After analyzing the country's civil society evolution process, the article elaborated the necessity of civil society in the development of harmonious society and analyzed the barriers in the process building up our country's civil society.In chapter 3, it analyzed the issue of strengthening the construction of rule by law in order to guarantee our civil society healthy development. It elaborated in three aspects: reasonable localization about the relations between the country and the civil society, establishment of public authority restriction mechanism and strengthening the construction of rule by lawIn chapter 4, it elaborated specifically about the issue of civil social organization's construction in the process of rule by law. Based on this, the article proposed feasible suggestion on establishing our country's civil social organization and perfecting comprehensive legal regime system. Through this thesis, the author hopes that the readers can get a primary understanding of civil society as well as its theories and practices. Meanwhile, the thesis could make useful suggestion to promote the development and consummation of the legislation and justice practice on civil society organizations in our country.
