Human Dignity is the fundamental conception about the"Human". It refers to people as human beings with the minimum qualifications, and comes from the inherent dignity recognized by human civilization. It is the status, treatment and respect that a human being must enjoy. Thus, human dignity is the concept with the richly religious and philosophical backgrounds. Its constitutional value lies in: human dignity is the core value of Constitution; and human is the purpose in the relationship of nation and human; and every person's intrinsic value should be respected; and everyone enjoys the right to self-realization. Although article 38 of the Constitution of PRC provides that human dignity is not violated, the reality of the protection of human dignity is unsatisfactory. Therefore, in addition to the Civil Code by increasing the area of privacy provisions, such as tort liability provisions will be further protected, in the constitutional level, we also emphasize the core status of human dignity and the applicability of the Constitution, and strengthen constitutional relief channels of human dignity.
