Ethical Issues Of Social Transformation Of Our Lawyers

Along with the continuous deepening of reform and opening up as well as establishment and improvement of the system of the market economy during the social transition period, the people's concept of the legal system has been continuously strengthened, and the demand for solicitor's also will be continuously enhanced in china, accordingly career of lawyers reaches to a considerable development. This paper studies and researches the current problems of occupational ethics lawyers from the solicitor's own subjective reasons and the practice of solicitor's objective factors.Combined with the traditional Chinese concept of inheritance and dedicated to the occupational ethics of foreign solicitor's from the Law Society, author find the way of strengthening the solicitor's occupational ethics in order to enhance the ethical standards of lawyers.This paper is divided into four main parts as followed:Part I, the outline of solicitor's occupational ethics. Studying from the basic connotation of solicitor's occupational ethics, author analysis the definition and elements of solicitor's occupational ethics and put forward three values orientation of solicitor's occupational ethics significance of the building of Occupational ethics during the social transition period of China.Part II, combing the course of the development of Occupational ethics of China and foreign solicitor. Author tries to find the essence and dross of theory for a modern society to study and to use for reference.Part III, the problem and the reasons solicitor's occupational ethics. Author show up the main performance of the lack of solicitor's Occupational ethics, and then analysis the causes of the problem of solicitor's occupational ethics from view of personal factors, historical factors, economic factors.Part IV, the way to resolve the problem of solicitor's occupational ethics. Author put forward four ways to build Occupational ethics. Seen from personal aspects, improving the quality of Occupational ethics counsel individuals; Seen from history aspects, changing the judicial privilege of justice; Seen from economy aspects, realizing the interaction between solicitor's occupational ethics and the market economy; seen from system aspects, setting up sound system of solicitor's occupational ethics.
