Privacy of patients is one of the elementary human rights, as well as human dignities. Starting from the late of 20th century, all the world has been concerning with the patients' rights, including their privacy. Even though the privacy right is the basic citizenship, medical deeds still have to impose on it, producing a sensitive region in which privacy right dissension come up continuously. Now we are facing an immergency to find the reason and its effective and measurable resolutions for the high-rated privacy right dissension. The article explores comprehensively the typical categories, the reasons and the protection from the patients' privacy right. The article is divided into three chapters.The first chapter begins with what on earth the patients' privacy right is. Through analyzing privacy and privacy right, we think it is no need setting aside an ultimate definition of privacy right, and it's necessary to understand privacy right from the pointview of the nature, the subjectives and objectives, the regulation scope. Meanwhile, the article points out the characteristics of patients' privacy right.The second chapter summarizes the main types of the patients' privacy right dissension. Taking into account of China's traditional law culture, the doctor-patient relationship, the medicine development and the present legislation and law conflict, this chapter analyzes deeply the reasons for high-rated dissension.The third chapter analyzes the ethical, juristic and social value ofsafeguarding the patients' privacy right according to the its reasons and the existing illegal phenomenon. It advocates that we give an effective protection from the perspectives of patients, hospitals and legislation by introducing the foreign advanced experience, in which there are resolutions of spreading compulsory education, strengthening self-protection consciousness, improving regulation and self-discipline of doctors, promoting legislation and providing full law service.
