Improve The Legal System Of China's Urban Housing Supply

Housing plays an irreplaceable role to each person,every family and every community.Everyone needs housing,however people obtain it in different ways.Under the market economy circumstance,people mainly obtain housing by market transactions.At the same time,there are some people who were unable to obtain housing by the market way because of the limit of people's capacities and the unfavorable objective conditions.Under such circumstances,as the provision of public services,the Government has obligation to provide citizens with appropriate living conditions.On the one hand,the housing supply structure system makes rules to regulate behaviors of housing supply in market.On the other hand,the system provides solutions to the lack of housing in low-income families.It solves the problem which the market system can effectively balance the housing supply and demand.Meanwhile,it can solve the all sectors' housing problems in the community.The system is not only affect the balance of housing market between supply and demand,but also influent the non-market housing security.At present,as a result of the system has been in the primary stage,there exit many problems in practice.Many researches of Chinese housing supply system are limited in science of economics,management;it is a lack of the research from angle of jurisprudence.So there is very important academic merit and practical significance for the construction of housing supply system to analyze the problem,especially legal problem that housing supply system confronted,and design operational and systemic legal norms.The housing supply must not only rely on the market,but also rely on the government.This article analyzed the jurisprudential theoretic foundation of the housing supply system,and put forward the necessity of building the law-system of the housing supply.It is important for us to analyze the history and current situations.We may also learn from the foreign countries in terms of the housing supply system.At last,by making a systemic and comprehensive analysis of the construction of the housing supply legal system from the microscopically and microcosmic aspects.The author hoped that these analyses can be beneficial to perfect the housing supply system in China.There are five parts in this article,about 40000 words totally.PartⅠSummary of urban housing supply.The housing supply system is the core of housing supply system.This part analyzed and defined the housing supply system,laid the foundation for housing supply system.Then by analyzing the research significance of urban housing supply,came to conclusion that housing supply should be the point of solving housing problem in China.Finally describing related policy of housing supply at present in China from the system level,analyzing the system attribute and summarizing basic characteristics of housing supply system to set forth the necessary of improving housing supply system.PartⅡThe theory basis of urban housing supply system.This part studied housing supply system from the view of Constitution and the Economic Law. In the view of the Constitution,the right to house is one of the basic rights of citizens which should be recognized through the state's fundamental law. From the point of view of Economic Law,the system of housing supply reflected the limited intervention from the state.It also reflected the social security which protected the vulnerable groups.PartⅢThe history and current conditions of the housing supply system. Firstly this part concluded the national macro-control means and values,which is focus on housing supply and people's livelihood protecting,by inspecting the reform in the housing system and governmental housing policy.Secondly, by inspecting and analyzing five stages of housing supply system,this part concluded the development regulation.Thirdly,this part discussed the problem that housing supply confronted and laid foundation for following discussion.PartⅣThe inspiration of the foreign legal system for the urban housing supply system.In this part,the United Kingdom and Singapore were selected to be a reference.By the way of introducing and analyzing related housing supply system,this part conclude these countries' experience in establishing housing supply system and pointed out the significance that these experience may affect to our system.PartⅤThe legal concept of urban housing supply in China.This part discussed the legal establishment of housing supply in China and is the focus of the article.This part established housing supply system in the macro-and micro perspective.From a macro point of view,first of all,establishing the basic principle of housing supply system,secondly making legislation to the housing supply,which improving the legislative level,and incorporating into the framework of housing law.This article discussed relative question about housing supply legislation from the whole perspective of housing law.Finally, trying to refine the specific norms of housing supply in the housing law.From a micro point of view,first of all,this article discussed the related supply system of housing supply,then reshaped the management agencies of housing supply,and finally designed related system of commercial housing, economical affordable house,low-rent housing separately.
