Rural Women's Rights Legal Protection Survey Empirical Research

The status of rural women's rights and interests is an important index to judge the level of new rural construction of our country. Paying attention to ensuring rights of rural woman is necessary to the construction of new rural and harmonious society. At present, the countrywide empirical research for rights of rural woman is relatively shortcoming. Based on the countrywide investigation for rural women's rights and interests, the author make the empirical research of political participation of women , domestic violence and female peasant workers' labor rights. And then, the author analyzes the cause with the method of gender analysis, and put forward the suggestions for ensuring the rights and interests of rural woman, with the purpose of providing the reference for our country department.The paper falls into 3 parts with 40000 words except the introduction.PartⅠ, the investigation for rights and interests of rural woman in our country. In this part, the author introduces the basic situation of the investigation in the beginning. The basic situation includes: 1. inquiring area is broad; 2.men and women have equally certain proportion and the female is above 70%; 3. middle-aged age people is above 80% in all respondents; 4.people with low educational background is the majority ; 5. married person accounts for 70% all above; 6.the respondents are engaged in the various job. Then, the author sums up the results of the investigations in three. Firstly, there are four aspects in the investigation of political participation of rural women, including: the participation rate of villagers' committee election, the cause of participation, the idea of holding the post in villagers' committee and the choosing to a director to village committee. Secondly, there are six aspects in the investigation of domestic violence in the rural area, including: occurrence rate, type, reason, cognition on "hot violence" and "cold violence", remedies approach and cognition on legal assistance. Thirdly, there are two aspects in the investigation of female peasant workers' labor rights, including: the rate of female peasant workers' labor and primary problem encountering. The author has analyzed the data one by one. PartⅡ, the analysis of the status of rural women's rights and interests guarantee. In this part, the author analyzes the status and reason of rural women's rights and interests guarantee. Firstly, the results of the investigation of political participation of rural women show: 1.the participation rate of villagers' committee election is low; 2. rural women are not very interest in political participation; 3. female's administrative ability can't be commonly accepted in rural area. Secondly, the results of the investigation of domestic violence in the rural area discover: 1. the acts of domestic violence occur usually in some rural area's homes in our country, and the domestic violence by men against women at home are fundamental type; 2. the masses has ratification to spirit violence; 3.the difference in family position between male and female is obvious in rural area and female resists sexual control. 4.the legislative consciousness remains to be improved further in rural area .Thirdly, the results of the investigation of labor rights discover: 1.the arrears of wage and over-time work still is the primal problem; 2. exist sexism; 3. peculiar protection for female peasant workers fail to be carried out. Then, based on the method of gender analysis, the author analyzes the reason.PartⅢ, the legislative suggestions to perfect guarantee system of women's rights and interests. In this part, the author put forward the legislative suggestions to perfect guarantee system of women's rights and interests. Firstly, on the political participation of women, the author suggests that: 1.add concrete proportion and by-election measure to Organic Law of the Villagers Committees of the People's Republic of China, 1998, and Law of the People's Republic of China on the Protection of Women's Rights and Interests,2005; 2. women's federation should supervise political affairs to the women more; 3.add superintend mechanism to Law of the People's Republic of China on the Supervision of Standing Committees of People's Congresses at Various Levels,2007. Secondly, on domestic violence against women, the author suggests that: 1. perfect local legislation preventing the domestic violence; 2. adopt the institution concerning the order of civil protection according to the practical situation in China. Thirdly, on female peasant workers' labor rights, the author suggests that: 1.make new regulation for peasant laborers and highlight the female peasant workers' labor rights; 2. establish women's court.
