An Empirical Investigation Of Hainan Female Migrant Workers' Rights Protection

In the process of construction of international tourism island in our province, more and more women join the ranks of migrant workers. They go out home, to the city for a job. Migrant workers are vulnerable groups of society, which belongs to the edge of the city, and female migrant workers seem to be more vulnerable in the vulnerable groups of society. Due to the dual problems of gender and identity, female migrant workers are often at the bottom level of occupation. This survey in 12 cities and counties of Hainan Province, female migrant workers work situation, love and marriage, living conditions, rights protection, future planning and other living conditions were investigated. Through research, gain valuable "first-hand information". This paper intercept some data and analyze in order to understand the real rights protection of female migrant workers in our province.This paper mainly analyzes the survey data and elaborates from the five aspects of employment, work, life, health protection and social insurance. Based on the existing data and collect relevant information, the author summarizes the experience and problems of rights protection of female migrant workers in our province. Specific experience are as follows:First, the special collective contract becomes the female workers' "amulet" in our province; Second, women's poverty inspirational school classes is a successful example of the pre occupation training; Third, the social insurance system is implemented at the forefront of the country, achieved remarkable success. Of course, the existence of many problems, including the following:(1)suffer discrimination in employment; (2) labor contract rate is low; (3) the rest right protection is not in place; (4)protection of the four stages of female workers has shortcomings; (5) workplace sexual harassment is serious; (6) the problem of living environment and housing security.Based on analyzing the cause of the problems, this paper puts forward some corresponding legal countermeasure, aims to promote the legal protection of the rights and interests of female migrant workers in Hainan, etc. Ideological level, shape the gender order and gender equality culture through strengthening the publicity of legal system; Regulatory level, play the regulatory role of government departments, and standardize enterprise employment law; Legal level, gradually improve the "labor contract law", and promote the collective contract legislation; And set up special courts in grass-roots court in order to protect women's rights; Institutional level, introduce the public interest litigation system, expand the use of the legal system of the subject and scope of application. Perfect the migrant workers housing security system by establishing residency system.
