Communist Party Of China In Accordance With The Law Governing The Need For Research

In the report of Sixteenth National Congress, the Communist Party of China carries out the concept of "governing in accordance with the law", which shows that in the process of modernization, "governing in accordance with the law" had gotten the recognition and support of the CPC. The necessity of governing in accordance with the law is why the CPC should choose these criteria. From the reality, the academic territory is still lacking of systematic and in-depth research .In this paper, on the basis of learning the achievements of theoretical research of governing according to the law in recent years, with the usage of social science theories, such as political science, law, sociology, and the usage of the historical research, the method of comparative study, as well as principle of the relationship of theory to practice, new research on the necessity of governing according to the law had been explored and the full text is divided into the following three parts:The first part is started from the party's historical experience, the characteristics and enlightenment about the three generations of collective leadership and governance of China are concluded. There are gains and losses of each period about the theoretical and practical exploration. Then the necessity and rationality of the existing of governing according to the law are got from the explanation.The second part started from the practical needs of Chinese social reality, analyzed the detailed question about democratic politics, market economy, advanced culture and harmonious society, and the governing according to the law is the need of reality is got.The third part analyzed from the angle of the experience of ruling parties abroad. The experience and lessons of ruling parties from socialist countries, and developed capitalist countries are concluded. so it is the necessary choice of a successful ruling party to administrate according to the law.From the three aspects of historical experience, practical needs and experience of the foreign ruling party. this article explained the necessity of the CPC to administrate according to the law comprehensively and systematically. The overall explanation and theoretical exploration of this problem can give more persuasive theories to governing according to the law in China.
