The Right Of Public Participation In Urban Planning Legal Protection

Taking a broad view of the theories and practices of urban planning in China, these researches on public participation in urban planning is still at the starting stage. Traditional top-down planning has still been applied to the majority of urban planning and management. If we want to extricate the urban planning from the present predicament, several absolutely essentia actions that we must take are to improve democratic degree in that field, to broaden the scope and the channels of the public participation. But this will not be carried out successfully if there isn't any effective law involved. Therefore it is urgent and essential for our country to set up a legal system of public participation of the urban planning.For now, though we have had the embryonic form of the legal system, we find that it still has hosts of shortcomings that are disadvantageous in guiding and attracting the public to participate in urban planning. In view of these serious problems mentioned above, the main purpose of my writing this thesis is to put forward some proposals and countermeasures for our legal system of public participation of the urban planning.The characteristic of the sociality and the extensiveness and complexity of urban planning has decided that the public participation made an important role in the field of city planning. After making a comparative study of the countries where the system of public participation is more advanced, this paper attempts to suggest that the system of public participation be implemented in city planning and to set forth some measures to carry it out by way of combining theoretical demonstration with analysis of concrete evidence.Besides the introduction, the thesis consists of the following four parts:ChapterⅠdeals with the characteristic and meaning of the urban planning, analyzed essential for our country to set up a legal system of public participation of the urban planning.In ChapterⅡ, foreign legal systems about public participation of the urban planning and involved experience are described. It also introduces briefly the system of city planning in different countries.ChapterⅢhas discussed the legal basis,present condition and problems of public participation of the urban planning in China.ChapterⅣanalyzed the feasibility of implementing the system of public participation in city planning and various proposals for making the system perfect.
