Study Of Rural Community Events Legal Issues

Currently, with the economy and society in Chinese rural areas being in the transition period, various relations of interests tend to be complicated, and social conflicts are in the frequently-occurring stage. As the special expression of social contradictions and conflicts, group affairs are soaring continuously in its quantity, enlarging day by day in its scale, more fierce in its manifestation. Therefore, rural group affairs have become the important factor which restrict our rural economic growth and affect social stability.Rural group affairs are constantly emerging and upgrading, which exposed our serious defects when dealing with rural group affairs on system construction, system reform, and management measures. Above problems brought severe challenges to our legal construction.The theme of this thesis is the legal study of rural group affairs, for the purpose of empirical analysis and theoretical discussion on legal problems occurred to rural group affairs, applying the keystone and basic theory of law. According to way of posing, analyzing and solving problems, this paper studies lots of cases occurred in different periods and regions in China' s Rural Areas, and screens cases with typical significance to analyze types and characteristics of rural group affairs. According to related regulations and concrete disposal measures of our country' s constitution and law, this paper analyzes defects of controlling rural group affairs in aspects of system construction and disposal measures, and then puts forward countermeasures to perfect legal system of control measures.Based on the above train of thought, the full text is divided four chapters and the contents of every chapter are summarized as follows:Chapter one discusses Chinese rural group affairs from four aspects: its concept, property, types and characteristics. Firstly, its legal definition is analyzed. Secondly, its property is described from the angle of Politics and Law. Then, rural group affairs are classified as the following four types: interests driving, fight and protection for rights, power contention and emotional catharsis model. Finally, it discusses mainly the characteristics of rural group affairs in our country.Chapter two correctly analyze the cause and effect of rural group affairs under new situation, based on its present situation and features. This chapter analyzes the cause of rural group affairs from the social and institutional reasons. It mainly systematically analyzes the institutional reasons from the defects of peasant rights and interests coordinated mechanisms, farmers' interests expression mechanism and the conflict mediating and disposing mechanism. Besides, it analyzes the negative influences caused by rural group affairs to the social development in our rural areas.Chapter three explores disposal systems and measures of rural group affairs, and studies which stipulations in the Chinese legal system involving the qualitative analysis and disposal to rural group affairs. At the same time, it analyzes the imperfections of these system regulations. Regarding individual case analysis as the springboard, it explores how the basic-level governments actually deal with rural group affairs. From the perspectives of managerial body, disposal content and procedure, the article puts special emphasis on analysis of limitation and validity concerning to the concrete disposal measures.Chapter four explores how to perfect legal systems of preventing and handling rural group affairs. Firstly, it is put forward to perfect mechanisms for the protection of farmers' interests, including interests coordinated mechanisms, farmers interests' expression mechanism, insisting on Running the Country according to Law, energetically promoting Construction of Rural Democracy and Legal System. Secondly, it is suggested to improve the mediation mechanism of rural contradictions, from aspects of the comprehensive control, intermediation, and group lawsuits, and so on. Thirdly, by improving and perfecting the basic legal system, the local legislation related to preventing and handling rural group affairs, it is proposed to improve the disposal system of rural group affairs, which consists of the perfections of the centralized leading system, the legalization of disposal contents and methods. Last but not least, the working mechanism building in dealing with group affairs should be improved, including information forewarning and preventing mechanism, emergency handling mechanism and safeguarding mechanism.
