Social Transformation During The Civil Governance And The Rule Of Law Significance

The article is based on the theoretical field of society transformation stage in China, which explores realistic impetus and theoretical desires of civil governance, defines the conception and characters of civil governance itself and civil social organizations as its subject, analyzes the development situation and current problems, demonstrates experiences and enlightenment of overseas civil governance, and illustrates the pursuit of rule of law and tendency of civil governance. In the term of logical network composed by legislation, administration, judicature and legal supervision in the course of legal process in China, the author discusses constitutional function, social function as well as legal function of civil governance, and positive effects of reflective bracket and medium bond in the relationship between the rule of law and spontaneous order. By the means of the analyses of fact and value, comparative analysis, systematical analysis and historical analysis, the author draws a conclusion that the civil governance can provide the legal process of rule of law with structural bracket and crucial impetus in the period of social transformation in China.
