Gay Marriage Legality

All along, the understanding of marriage is always built on the basis of gender integration. So this combination became a kind of potential rules. In the face of the demands of gay marriage rights, this rule has shown indomitable spirit of resistance. However, with the movement of gay rights liberation and human rights, people's attitude to homosexuals has changed. Same-sex marriages protected by law and are entitled to the rights of marriage and family in some countries and regions. With the development of human society, Same-sex marriage which emerged as a new legal phenomenon has generated a number of issues of conflict of laws in the international judicial practice, as well as scholars in various fields have led to widespread concern. In this paper, the author compares and analyzes the same-sex marriage by way of history, comparison, sociology of law as well as brief idea of post-modern law, and then sums up the development of legislation model of same-sex marriage in international community. Finally, some suggestions are proposed for same-sex marriage in our country after the research on the private international law issues caused by the practice of same-sex marriage legislation in other countries.
