Exercise Of Executive Power In The Public State Of Crisis

Emergency occurred frequently in recent years, which bringed great disaster to our society and therefore management have been caused for concern. This thesis is based on the current legal construction of emergency , especially compared with western countries and borrowed from it to find deficiencies of exercising political authority under the current policy crisis of our country , and adopt advanced system of foreign countries to build our legal emergency construction based on our national conditions. First the thesis researched on the characteristics of the three elements that has close connection among emergency,public crisis and public crisis state theoretically and straighten up the relationship among them . Secondly the thesis researched on the exercise of the executive power under public crisis and public crisis state and this is the principle theory indication. Third, this thesis researched on the current legal construction of emergency of several key western countries and evaluated boldly and borrowed from it. Last ,the thesis combined with theory research of the first four chapters and foreign experience and also the current situation of legal construction of emergency of our societyresearched on the exercise of executive power, under public crisis.
