The promotion campaign of legalization since 1980s has been trying to set up a modern legal system across rural areas in China, however, the system represents a set of knowledge and rules which was quite unfamiliar for native residents at the very beginning. Because of the discrepancy, there happened to be lots of problems during the legalization of Chinese rural society.Law-sociology has introduced a new perspective in the research field related with law and community, which not only holds that the legal system is part of the complicated social controlling system, but also provides a new research tool, the empirical study. Following this way, the thesis makes a conclusion that the legal system in Chinese rural community at present is in a state of sub-health through survey research. According to this conclusion, with the analysis of the external law circumstance, the internal economic-social needs, the traditional culture as well as individual behaviors, the dissertation deduces that the prospects of Chinese rural legal system will be bound to develop amidst twists and turns in the foreseeable future.The structure and main content of the thesis read as follows:Chapter One on one hand introduces the domestic and overseas research of law-sociology and that on Chinese rural society; on the other hand, paraphrases the definitions of rule of law, rule by law and legal system used in this paper. Chapter Two narrates the methodology, the design of research and the investigation poll. Chapter Three explains and analyzes the investigation results, and concludes that town D is in second health disorder on the construction of modern legal system. Chapter Four analyzes systematically the factors affecting the legal system in town D based on the poll results, interview materials and the published works. Chapter Five, makes a conclusion that the developing rural economy and community desperately needs the legal adjustment firstly; the second is that the rural people's legal awareness and behavior is accelerating forwards; the third one is reflecting on the increase of law violation and fudge-ability; and the last ends with the continuous interaction and interdependence between the modern legal system and local order and regulations of Chinese rural community.In conclusion, this paper highlights in the empirical study on the legal system of a selecting area, the systematical analysis on the factors affecting the rural legal system and the deduction of the development of Chinese rural legal system based on the investigations.
