Volunteer services refer to services provided, without any desire of exchange or returning, for welfare of human beings and improvement of society. As an important part of the social welfare system, volunteer services are able to make great contributions to remedy the lack of social securities, to keep smooth of the social orders, to help the youth anticipate in social activities and to serve economic and moral constructions. Further more, volunteer services will be helpful to construct the harmonious society and to help the human beings upgrade. However, volunteer services in China are now far from being satisfactory, due to the imperfect legislation and legal systems and the inaccurate attitude of the mass toward it. This paper, starting from the current circumstances and legislation environments of volunteer services in China, comes up with proposals and suggestions to improve the legislation of volunteer services based on deduction and induction of foreign counterparts, by a combination of methods of comparison analysis, demonstration analysis and analysis.This paper consists of four chapters besides the preamble.The preamble lists the background and importance of this study. After the background and the current circumstances, comes the necessity of the suggestions and proposals thereafter.Chapter I analyses the major problems in the protection of volunteers, and proposes where these problems lay through comparison of foreign experiences and achievements. Firstly, lack of laws or regulations makes the protection of volunteers footless; Secondly, the relationship between volunteers and targets of services are unclear, making the rights of volunteers hard to define; Thirdly, protection of volunteers is easily to fail due to lack of material supports; Fourthly, volunteer service confronts with difficulties because of the inaccurate attitude of the mass towards it; And fifthly, volunteer organizations are always unaware of such protections of volunteers. After this, this chapter provides a thorough comparison of the situation in China and experiences in foreign countries, forming a basis for further analysis.Chapter II analyses the legal status of volunteer services in China and provide the theoretical basis for the afterward analysis of detailed circumstances and proposals and suggestions. This chapter discusses the legal components and characteristics of volunteer services, and legal status of volunteers and volunteer organizations. Finally, this chapter analyses the legal relationships in volunteer services including the relationship between volunteers and volunteer organizations, relationships between volunteers and targets of services, and relationships between volunteers and any third parties other than the targets of services.Chapter III concludes that legislations and legal environments of volunteer services in China are inconsistent and far from being satisfactory, and upon which provides suggestions and proposals. The analysis includes the local legislations of volunteer services in 22 provinces or cities. The suggestions and proposals are provided based on inductions of foreign experiences and legislation systems in China.Chapter IV concludes problems other than the problems in Chapter I and provides related resolutions. The resolutions include: to pay the volunteers reasonable rewards and improve legislations in such fields; to further protect volunteers by improving legislation and the legal environments; and to bring the supports to volunteers into the social security system and to improve the person-insurances of volunteers.
